Press Release:(a) IRS requested Pil Orbison/Busienss owner of C-Corporation Bay Area Diversified Tennis Foundation to fax the Letter of Notice of Intent, to file a lawsuit, to hold the Collection on the IRS Tax imposed on the "Embezzled Income" reported in the 2020 Tax Return.  This letter was faxed to IRS on May 03, 2021.

--(a-i) Claim filed re. Wrongful Death Claim "$1Billion" and Business Loss for FY2019-2020/Amended over $9,81M with cumulative interests, excluding the grant that is undisclosed by the two cities.  IRS and FBI and State Finance Department notified via Express mail.

(b) Appeal to vacate the Vexatious Litigant Order requiring Prefiling Order/Judge's Permission to file lawsuit under " Business Pil Orbison, dba. Bay Area Diversified Tennis Foundation," and to Remove "Pil Orbison, dba, Bay Area Diversified Tennis Foundation," from the Judicial Council Vexatious Litigant List--This is fraud and City of Hercules and the City of Berkeley used the Vexatious Litigant Order to fraudulently claim on the ownership of Pil Lee Orbison's business that was not tax exempted on the embezzled "Grants"( Berkeley Minutes March 17, 2020and April 23, 2019, 4 PM, Special Council Meeting, and city of Hercules Minutes of April 12, 2016, January 08, 2019 and February 23, 2021/Street Pavement proposed by the Embezzler David Biggs' unreturned grants with interests.  Per the announcement of Hercules City Manager Departure to Orinda on 4/1/'21.This philanthropic org. Bay Area Diversified Tennis Foundation operated by Pil Orbison is awarded as "The 2020 Best of Berkeley" Business chosen by the Berkeley Business Recognition Program on January 12, 2020.

(c) IRS Lien and US Tax Court Trial held and its is subject to filing a lawsuit by Pil against the  Ci. of Hercules, Biggs, as individually and as City Manager, and City of Berkeley for unreturned or sans a contract undertaking the project with "Federal Grants received in prior years" to be used for Community nonprofit agencies in FY2020-FY2023, per April 23, 2019, 4 PM Special City Council Meeting Minutes, however the Matching grant amount "$3M" being allocated to the Homeless, per March 17, 2020.  February 14, 2021, City of Berkeley destroyed the tennis court constructing out of my business architectural plans which began with a PowerPoint Presentation materials presented at October 08, 2014, preceded at the Parks, Recreation and Waterfront Committee ("PWA") Meeting on 9/10//14, after the initial Proposal IN JUNE 2014  with architect Paul Ferro at form4 Architecture Inc. and myself  with Park and Rec. Director Scott Ferris.  


(d) The Former City of Hercules Manager REFUSED a THIRD-PARTY AUDIT.  Evidently CITY SPECIAL MEETING of MARCH 2015 was removed CONTAINING THE TARAMAR DEVELOPER SETTLEMENT "$250K OFFER" FOR WITHDRAWING THEIR BID CONTRACT, AND PIL IS SUBJECT TO RECEIVING SOME CONSULTATION FEE AFTER PROTESTED ON THEIR PROPOSAL FRAUD ON THE LANDSLIDE ZONE IN HERCULES. 


(e)  CRIMINAL COMPLAINT  and Notification of Fraud to the US Attorney General Office, sent on October 19, 2020.  "Undisclosed Cash grant '$2.5M plus Interests," per Auditor Cliffton Larson Allen LLP, CPA firm, and the State Finance Dept Due Diligence Letter, and "Grand Jury Report enforced to return "$805,072" at April 12, 2016 that was found to be misallocated for FY2018 and its Minutes were approved on misallocated funds "$971,701" and "$250K" for Romero HOA and Kelley's HOA approved, respectively, in the following tax year at January 08, 2019 Hercules City Council Meeting.  Total known Embezzled Grants were "$3,338,899" and the former Hercules City Manager used them for Briberies showed in the FY2018 TAX, ending on June 30, 2019, on account of IRS TAX DEBT "$1,125,567.98" filed on the owner of the business on December 30, 2019.  Claim filed on February 23, 2021.

Architect Bernard Maybeck's Original Sketch/Layout of the Municipal Berkeley Rose Garden prior to its actual construction work: 4 1/2 tennis courts at the upper terrace, and a garden and a swimming pool-to-be at the lower terrace.  The drainage pipes run from Codornices Park on the east Euclid Avenue to the base of the main Rose Garden.  No Cedar or Sequoia trees were in the original plan.

On Feb 26, 2019,  April 24, 2018 and Nov  07, 2017 Berkeley City Council Meeting, RPF have been funded without actions taken on the Agendas. Orbison requested to include the 1-acre under-developed lot with ADA compliance and part of the amphitheatre as a whole with increased budget of "$6M," and November 2016 Ballot Measure it was approved. 

At Oct 31, 2017 Berkeley City Council approved $5M RFP (Request for Proposal) for Economic Development Agencies for FY2018.

No Tree Sitters, Please:  There was no other landscape plan other than the current Maybeck's amphitheatre to be implemented in the original plan.

In addition, these root systems damaged one of the drainage pipes in the past and have been very invasive damaging the tennis courts surfaces and paths.  

(Estimate cost of resurfacing one tennis court:  $10,000-$15,000.)

​This requires a special engineering with geotechnical support and and resurfacing after relocating the underground drainage pipes.   

(Currently four Cedars, three Sequoia trees, Palm and Acacia trees are growing next to the tennis courts on the upper terrace and the ramp off the Euclid Ave, and we're proposing these to be removed and replace with less-invasive, like climbing roses and small shrubs.


And it will need to be widened up to 14 feet on the ramp for  trucks and and to make the tunnel road accessible for the handicap with new lighting design.
